Terms and Conditions

These Terms and Conditions must be read carefully before using the %TITLE% website (“Website”). By using, visiting, registering with and playing on the Website, the Players accept and agree to be bound by these Terms and Conditions, which regulate the relationship between the Operator and/or the Bookmaker and the Player for the whole duration of and in connection with the Player using and playing on the Website. These Terms and Conditions may be changed at any time.

Changes of these Terms and Conditions will be notified to the Players by publishing the updated version hereof on the Website. The new version of these Terms and Conditions is valid and effective as of the date specified above and remains valid and effective until replaced by an updated version. It is the Player’s responsibility to verify and, if updated, to acknowledge the most up to date version of the Terms and Conditions each time upon visiting the Website. The Players may be required to confirm and accept the updated version at next login onto the Webpage. Players may be prohibited from the use of the Website should they refuse to accept and confirm the Operator’s terms.

Where these Terms & Conditions are published in several languages, the English version of these Terms & Conditions will supersede and take precedence over any conflicting elements with the versions published in other languages. Capitalised terms used in the Terms and Conditions are to be understood and interpreted as defined below in section 2 (Definitions) hereof.

Acknowledgment

1.1 The Website and the thereon available games are operated by the Operator.

By participating in the Bookmaker Games, Players order Bets on the results of official or state-run lotteries such as, “Euro Millionen”, “Euro jackpot”, “SuperEnalotto” and others. The Players are aware that they are not participating directly in the Underlying Lottery and that the Operator is not an operator of any of the Underlying Lotteries, upon which the Bookmaker Games are based.

Definitions

2.1 Bank Account – Player’s bank account held with a commercial credit institution, last provided by the Player to the Operator and associated with the Player Account.

2.2 Bank Card – a debit, credit or prepaid card or any other card issued by an official payment and/or credit institution and used as a method of payment by the Player on the Website.

2.3 Bet – a bet, ordered to be placed by a Player on the Website as further defined by these Terms and Conditions, on a determinable outcome of a real event, in particular on the result of an Underlying Lottery in a relevant draw offered on the Website.

2.4 Bet Deadline – the deadline for participating in a Bookmaker Game determined for each draw and published on the Website.

2.5 Bookmaker Game – a lotto-style game available on the Website, based on the results of the Underlying Lottery.

2.6 Booster Ball – a function available on the Website allowing Players to vastly improve odds on placed Bets in comparison to those offered without using the Booster Ball function.

2.7 Boost-o-meter – a digital slider displayed on the Website allowing the Players, when using the Booster Ball function, to adjust their Stake.

2.8 Covered Bets – all winning bets covered by the relevant risk cover provider; the Covered Bets are not limited to Operator Winning Bets.

2.9 DLTB – association of members of the German lottery and pools (Deutsche Lotto- und Totoblock) operating several official lotteries, one of which is the German lottery “Lotto 6 aus 49”.

2.10 DoubleJackpot – an additional option a Player can select on the Virtual Betting Ticket, which, when enabled by the Operator, doubles the Player’s Winnings.

2.11 Excluded list – any person citizen of or resident in a country currently listed by the FATF; any person listed on the financial sanctions list of HMRC; any person listed on the UN sanctions list; any person resident in the United States of America, Belgium, France.

2.12 Jackpot – the maximum possible Winning at the Operator in respect of the relevant draw and Prize Category/Prize Categories of the relevant Bookmaker Game or the sum thereof as displayed on the Website.

2.13 Kootac N.V. – the company Kootac N.V., with its registered office at 13 Wilhelminalaan, Curacao, with registration number 129627, officially licensed by the Government of Curacao (license No.8048-K1208670 and license No. 8048/JAZ2013-014).

2.14 Loterías y Apuestas del Estado or LAE – the Spanish lotteries organisation that co-organises the “Euro Millionen” lottery for Spain.

2.15 MUSL – the Multi-State Lottery Association, which organises shared lotteries including the “Powerball” and “Mega Millions” lotteries.

2.16 NumberShield – an additional option a Player can select on the Virtual Betting Ticket, when enabled by the Operator, which entitles the Player to undivided Winnings in case of other winners.

2.17 Operator – the company Kootac Trading Limited, incorporated under the Laws of Malta with registration number C60661, with its registered seat at 30, Kenilworth, Sir Augustus Bartolo St., XBX 1093 Ta’ Xbiex, Malta. The Operator is officially licensed by the UK Gambling Commission (license No. 000-044791-R-324883-001).

2.18 Operator Winning Bet – a winning Bet for a Bookmaker Game, which was successfully submitted directly or indirectly, via Internet, telephone or other channels, and placed by Operator on behalf of the Player with Bookmaker, including possible winning Bets introduced through a third party to Operator and then placed by Operator on behalf of the Player with Bookmaker.

2.19 Pay Out – the amount, which the Underlying Lottery Operator has to pay out or has already paid out in respect of a correctly matched Underlying Lottery Winning Ticket for a relevant draw in a relevant Prize Category.

2.20 Player – a registered user of the Website, holder of an active Player Account.

2.21 Player Account – the account created by a Player on the Website; the Player must be logged in into his Player Account to be allowed to order Bets and pay the Stakes.

2.22 Play Slip Number – the number shown on or assigned to a Virtual Betting Ticket for a Bookmaker Game.

2.23 Privacy Policy – set of rules comprised by these Terms and Conditions and/or by a separate document published by the Operator on the Website defining the purpose and the processing of the Player’s personal data.

2.24 Prize Category – the amount of numbers in one Bet correctly matched with the winning numbers of the Underlying Lottery (including Super Numbers, Stars, Euro Numbers, Dino Numbers, Powerballs, Megaballs, and/or JollyNumber as applicable) determining the Prize Category in the relevant draw of a relevant Bookmaker Game.

2.25 Reference Currency — the currency in which the Stake for a Bet was displayed of the Website or the currency in which the Bet was ordered to be placed.

2.26 Sisal — the Italian lotteries organization that organizes the official Italian lottery Enalotto among others.

2.27 Stake – the sum of money the Player places on Bet(s), shown on the Virtual Betting Ticket including any service fees.

2.28 Terms and Conditions – these Terms and Conditions including the Privacy Policy, Promotional Terms and Conditions, Bonus Rules and Game Rules.

2.29 Underlying Lottery – an official or state-run lottery a Bookmaker Game is based on.

2.30 Underlying Lottery Jackpot – the aggregate amount payable by the Underlying Lottery Operator in respect of all Underlying Lottery Winning Tickets in Prize Category 1 and/or 2 and/or 3, as applicable for the relevant Underlying Lottery, in respect of the relevant draw of the Underlying Lottery, as announced by the Underlying Lottery Operator or, in a condition where no such Underlying Lottery Winning Tickets are announced, the amount that would have been payable by the Underlying Lottery Operator, had there been an Underlying Lottery Winning Ticket in the relevant Prize Category/Categories and in respect of the relevant draw.

2.31 Underlying Lottery Winning Ticket — a winning ticket for a relevant draw of the Underlying Lottery organised by the Underlying Lottery Operator.

2.32 Virtual Betting Ticket – the electronic ticket displayed on the Website, allowing the Players to order one or more Bets.

2.33 Website – the internet portal of the Operator, which is available at %TITLE% and which may refer to other joint or mobile websites, which are also operated by the Operator within the same or another domain or within the same or another brand, and any subdomains operated by the Operator (*.playeurolotto.com) or top level domains (www.playeurolotto.*) as well as iframes or comparable contents made available by the Operator within the internet pages of third parties.

2.34 Winnings – the premium or prize payable to a Player in respect of an Operator Winning Bet placed by that Player.

Contractual Parties

3.1 The Player must register on the Website and provide the required details before participating in any Bookmaker Game or whenever thereafter if required by the Operator. By registering on the Website, the Player enters into a contract with the Operator for the use of the Website and the operation and management of the Player Account.

By purchasing a Bet, the Player enters into a contract with the Operator, instructing him:

  1. to place the Bet with the Bookmaker on the Player’s behalf;
  2. to deduct the Stake from the Player Account;
  3. to pay the Stakes to the Bookmaker; and
  4. to pay-out the Winnings received from the Bookmaker to the successful Player.

With the exception of Bets purchased by Players resident or located in the UK, Kootac N.V. acts as the Bookmaker. Players resident or located in the UK are advised to use our UK website.

The Bookmaker determines the odds, calculates the Winnings and regulates the terms and conditions for all Bets ordered; the rules of the Bookmaker Games; and the Player’s entitlement to Winnings payable to the Operator for distribution to the Players.

The Operator provides its services and products to UK Players in reliance on the Operator’s license issued by the UK Gambling Commission.

Player Account

Player Account Registration

4.1.1 By registration on the Website, and thereafter at any login into the Player Account, the Player represents and warrants that:

  1. They have read and understood the Terms and Conditions;
  2. They are registering and using the Website in their own name and not on behalf of any third parties, for personal, recreational and entertainment purposes only;
  3. They are over 18 years of age, or over the legal age for gambling in their country;
  4. They are not, at the time of placing a Bet, a director, officer, or employee (or their spouse or dependent) of the Operator, of the risk cover provider, or of any of their associated or contracted entities;
  5. They are aware that they may lose their Stakes;
  6. They are not depositing funds originating from criminal and/or other un-authorised activities;
  7. They will pay any Bank charges and taxes accruing on Bets and Winnings;
  8. They will not use the Website for any commercial activity;
  9. They have only one active Player Account;
  10. They are not persons, or from a country on the Excluded list;
  11. They are not located at the time of ordering a Bet in any country in which it is not permitted to participate in remote betting/gaming products offered on this Website;
  12. They are not involved in any fraudulent, collusive, fixing or other unlawful activity in relation in the Player’s own or any other Player’s participation in any of the games and products on the Website and do not use any software-assisted methods or techniques or any hardware devices for participation in the offered products;
  13. They do not, in any way, use robots and programmed devices to participate in the offered products.

4.1.2 The Player is required to register on the Website to open a Player Account, to have access to all services available on the Website and to order Bets. The Operator reserves the right to refuse a registration of a Player for any or without a reason.

4.1.3 The Player may be asked to provide personal data, and relevant documentation evidencing the provided data, during or after the registration process or prior to effecting a deposit, product purchase or prior to a pay-out of Winnings, in particular the full name, residential address, date of birth, email address, telephone number, gender and payment method data as well as other information relevant for the use of products or services provided by the Operator.

By providing this personal data and documentation the Player grants the Operator permission to process and verify these, including but not limited to, the verification of their age, identity and residence. The verification can be carried out directly by the Operator or through a third party provider. The Operator is not responsible for failure to pay out Winnings, if the Player has not provided a trustworthy evidence for verification of the requested data, or if a Player is found to have provided incorrect, incomplete or expired data. The Operator is under no obligation to substantiate any data given by the Player or to make contact with a Player to complete or change any of the data registered on the Website or provided at any time thereafter.

4.1.4 The Player shall make sure that all details in respect of their payment method data provided by them during registration and payment respectively are complete, up to date and accurate and the payment method is in their name.

4.1.5 The Player shall directly and promptly inform the Operator if their Bank Card or other payment method used on the Website, is lost or stolen. The Player shall also inform the Operator if passwords and/or confidential information registered in the Player Account have become known to third parties or compromise is suspected.

4.1.6 The Player shall regularly update their Player Account with any changes to their personal information provided during the establishment of their Player Account by using the functions available on the Website in the My Account feature.

4.1.7 Players are limited to one active Player Account at any one time. A Player Account is active only if it was not self-excluded, closed, suspended or otherwise terminated or restricted by the Player or by the Operator. If any further Player Account is active in the Player’s name, the Operator shall be entitled to close or otherwise restrict any such accounts without notice.

4.1.8 The Operator shall be entitled, in its discretion, to define different minimum and maximum amounts for deposits and Stakes during a particular time period for a particular Player; when such limits are set by the Operator, these will be available on the Website.

4.1.9 The Player is required to keep all Player Account access information in a safe and secure place in order to prevent unauthorised access to the Player Account. The Player is responsible for all activities and transactions conducted through their Player Account. Players are also advised to use secure passwords, preferably 7 or more characters in length and containing upper case, lower case, numbers and or special characters.

4.1.10 The Player is not authorised to use a Player Account registered in the name of other persons or to allow third parties to use his Player Account.

4.1.11 The Player must immediately report to the Operator any known or suspected fraudulent or illicit use of their Player Account as soon as they become aware that it may be being used by another person or persons. The Player should also take any other actions as may be required in order to prevent its further abuse, such as by immediately changing the password on the Player Account. Any activity carried out on a Player Account is deemed to have been carried out by the Player registered as the holder of that Player Account.

Self-exclusion

4.2.1 The Self-Exclusion option available in the Player Account locks the Player Account for the selected time period. When selecting the Self-Exclusion option, the Player will not be allowed to access their Player Account, deposit and withdraw funds and participate in the Bookmaker Games.

The Players may choose the Self-Exclusion option by contacting the Operator’s Customer support services or use the Self-Exclusion Button in the Player Account.

4.2.2 The Player may choose the duration of the Self-Exclusion from 6 months up to 60 months. If no duration is selected by the Player, the Operator shall exclude the Player for a minimum of six months.

4.2.3 When selecting the Self-Exclusion option, future Bets may be voided.

4.2.4 Player Accounts that have been self-excluded can only be re-activated after the expiry of the Self-Exclusion time period and after the cooling-off period has passed. For re-activating their Player Account, the Player must contact the Operator’s Customer Support Service.

Players, which have chosen to self-exclude, might consider extending their gambling limitations to other gaming sites as well.

Closing Player Accounts

4.3.1 Players may close their Player Account permanently by using the “Close account” feature in the Settings section of their Player Account or by contacting the Operator’s Customer Support Service.

4.3.2 In order to close the Player Account permanently, there can be no active Bets linked to the Player Account, which have not been played yet and no credit balance. Players should withdraw and credit balance and await active Bets to be settled before proceeding to close their Player Account.

4.3.3 Players can view a list of all active and settled Bets under the Bet History and Active Bets sections of their Player Accounts.

4.3.4 The Operator shall be allowed to inactivate a Player Account if it has not been accessed by the Player for at least twelve (12) months (inactive Player Account). Before inactivating, the Operator will try to contact the Player via the email or telephone contact last provided in the Player Account. In case the Operator is not able to reach the Player within four weeks and cannot specify their bank details for the transfer of a possibly remaining balance, the Player’s claim to this balance expires. The Operator is entitled to remit the balance on the Player Account to the Operator’s regulating authority or utilise the outstanding balance at their discretion including, and not exclusive of, a donation to a charitable organisation.

Deposits and Withdrawals

Deposits and Payment Methods

5.1.1 The Player may deposit into their Player Account by using various options available on the Website through the ‘Deposit Money’ function under My Account option. Generally, the following payment options are available, however these may differ and change depending on the country of the Player:

  1. Debit or Credit Card (Visa, Master Card)
  2. Skrill
  3. Bank Transfer

5.1.2 With a direct debit order and authorisation respectively, the Player agrees and grants the Operator or its appointees the authorisation to debit the appropriate amount from the Bank Account last updated in the Player Account.

5.1.3 In case of a direct debit being returned, the Operator may refuse to accept further payments. The Operator is entitled to transfer claims against a Player, including any possible additional fees, to a collection agency.

5.1.4 Online wallets and Credit/Debit Card deposits will be immediately credited to the Player Account. In the case of bank transfers, the Player has to state their player username in all bank transfers. Bank transfers will be credited to the Player Account only when the funds have been credited to the Operator’s bank account. Such deposits may take 2-3 days to be processed.

The Operator may require documents and information from the Player, or from a third party, when deposit and/or anytime thereafter in order to prove, in particular that, the Player is not underage, the provided payment method is held in the Player’s name and that the Player has provided true, accurate and complete information. The Operator may repeat this procedure at any time it considers appropriate. Funds deposited onto the Player Account may be available after such verification procedures are completed.

5.1.5 In cases where a payment to the Operator from a Player, or a deposit in a Player Account, is stopped, interrupted, returned or for any other reasons not finalised or in cases where such payment is cancelled afterwards or theft or fraud are obvious in this case, the Operator shall be entitled to debit the relevant amounts from the Player Account, including any further fees charged to the Operator. The Operator reserves the right, i. to set off against a Player’s Winnings the amount of any unpaid Stakes or other fees.

5.1.6 The Operator is not a financial institution and thus, credit balance of a Player’s Account does not generate any interest.

5.1.7 The credited amount deposited by the Player and the payable credit balance on the Player Account respectively are held in a bank account in the name of the Operator and are not subject to any particular escrow or guarantees for protection in the event of insolvency.

Customer funds held by the Operator on behalf of Players from UK are held in a separate account and they would form part of the assets of the Operator’s business in the event of insolvency. The Player may lose any money stored in their Player Account. For further information, Players from UK may refer to the Rating System of the UK Gambling Commission.

Such customer funds include, without limitation, (i) cleared funds deposited with the Operator to provide for Stakes in respect of future gambling, (ii) Winnings and (iii) any unpaid bonuses, if such are awarded to the Player.

5.1.8 The Operator is authorised to debit the Player Account with applicable expenses, which appertain to the costs incurred by the Operator owing to the execution of assignments from a Player or the execution of an order.

5.1.9 Transfers are cleared in the Reference Currency. For such transfers, Operator reserves the right to charge the Player with the fees charged by the financial institution. The Player must provide proof to the Operator that the Bank Account is opened in their name.

5.1.10 Fees applicable to transactions on the Website are listed in the Fees section of the Website.

5.1.11 The Players are not allowed to transfer funds from their Player Account to other Players’ Accounts or to receive funds from other Players’ Accounts, to transfer, sell and/or acquire, other Player Accounts.

Withdrawals

5.2.1 The Players may only withdraw Winnings credited to their active Player Account. Promotional Terms and Conditions or special Bonus Rules may specify exceptions, such as withdrawal of Bonuses. Withdrawals are made to the same payment method (credit card, Bank Account, etc.) they originated from held in the name of the Player and may be subject to Player identification.

5.2.2 Minimum amounts of withdrawal may be introduced and may vary for different jurisdictions.

Anti-Money Loundering

6.1 All transactions may be reviewed in order to prevent money laundering. The Operator will report any suspicious transactions to the relevant authority. If the Player becomes aware of any suspicious activity, the Player is required to report this to the Operator immediately. The Operator may suspend, terminate or close a Player Account and withhold any funds and Winnings for purposes of Prevention of Money Laundering.

Rights of the Operator

7.1 The Operator shall be entitled to suspend any Player Account from the use of the Website, if the Operator believes that a Player does not meet the requirements specified in these Terms and Conditions. In addition, the Operator shall be entitled to not open, terminate, vary or suspend the relevant Player Accounts from the use of the Website, cancel any Stakes, withhold Winnings and apply funds available on the Player Account to settle any damages caused by the Player, immediately and without prior notice, if:

  1. the Operator believes that the Player has provided false or misleading information when registering or updating their Player Account, submitting information about any payment methods or otherwise in connection with the Website and the services available through it;
  2. the Operator believes that the Player is involved in any fraud related or illicit criminal activities;
  3. the Operator believes that the Player maintains more than one active Player Account;
  4. the Operator believes that the Player is in breach of any substantial provision of these Terms and Conditions;
  5. the Operator believes that any details of the Bank Account or Bank Card were, or have become, incorrect, incomplete, invalid or the Bank Card is reported lost or stolen or is connected in any way to fraudulent activity;
  6. the Operator receives a negative appraisal of creditworthiness for a Player;
  7. any direct debit collection due from a Player is returned for reasons attributable to the Player;
  8. the Operator believes that the Player has allowed a third party to place Bets using their Player Account.

The Operator may, additionally, suspend or terminate any Player Account, held by a UK Player if the Player’s age could not be verified within 72 hours after depositing funds onto the Player Account.

7.2 During the period of any such suspension of a Player Account, the Player will not be allowed to access or use their Player Account. Furthermore, the Operator may investigate the event/s that initiated the suspension and the Operator will be entitled to require that the applicable Player provides all such identification documents as the Operator may require.

7.3 Should the Operator discover that the event giving rise to suspension has occurred, the Operator shall be entitled to permanently terminate the Player Account in question. The Operator may choose to do so once any outstanding Stakes associated with that Player Account expire or otherwise may at its discretion, authorise the Bookmaker to void such Bets. If the Stake was paid by a Player under 18 years of age, the relevant Bets may be voided, in which case the Stake will be returned by the Operator to that Player’s payment method and the Player Account will be closed with immediate effect. The Operator has the right to withhold any Winnings attributed to suspended Player Accounts.

7.4 Should the Operator establish that no breach has occurred, the suspension of the Player Account will cease. The Player has no claims towards the Operator as a result of such suspension, even in the event the Operator establishes that no breach has occurred.

7.5 If the Operator terminates a Player’s Account for any other reason, the Operator will notify the Player by email, using the email address last updated with the Player Account. In these circumstances, the Operator shall rebate the balance held on the Player Account to the Player’s payment method, after taking into consideration any active Bets, bank fees.

7.6 The Operator shall not pay Winnings and is authorised to instruct the Bookmaker to void any Bets, even after the relevant draw in particular, if:

  1. the Operator was instructed to place a Bet/s after the Bet Deadline or after the start of the relevant draw and/or if the Operator incorrectly accepted an instruction to place a Bet/s on the Website after the relevant Bet Deadline or after the start of the relevant draw;
  2. There is an error in relation to a Bet or Underlying Lottery draw and such error is not corrected before the Bet Deadline;
  3. the Operator was instructed to place a Bet by a Player who does not legitimately hold a valid Player Account, has chosen to self-exclude from the Operator, has provided false, incomplete or outdated information associated with their Player Account or otherwise related to the Website or any of the services available through it;
  4. the Operator becomes aware of a genuine mistake in relation to a Bet or draw and is not able to contact the Player to correct the error or confirm the Bet prior to the Bet Deadline;
  5. the Operator was instructed to place a Bet by a Player who is involved in any fraud-related activities relating to the purchase of the Bet, the operation of the Player Account or relating to the Website or the services offered by the Operator
  6. the Operator was instructed to place a Bet by a Player who was, at the time of placing the Bet, in any of the countries on the Excluded list, or was less than 18 years old (under the legal age for gambling), or was a director, officer, or employee (or their spouse or dependant) of the Operator, its risk cover providers or their group companies;
  7. the Player maintains more than one Player Account.
  8. in conjunction with any draw, fraud and/or technical and/or human error or unwarranted influence was found or;
  9. the draw is declared by an Underlying Lottery Operator or co-organiser as being invalid
  10. the Player is found to be or has been at any time in breach of any representation or warranty provided by him under these Terms and Conditions;
  11. the Player fails to provide sufficient documents and information to the Operator to verify his identity, the provided data and the authorization to use the chosen payment method
  12. the Operator is not allowed to pay due to regulatory or legal limitations.

7.7 The Operator reserves the right to change, in particular to lower, the amount of Jackpot for any Bookmaker Game in respect to any Prize Categories in its sole discretion, at any time, before or during the relevant draw. It is understood, that the Operator will change and correspondingly adjust also the calculation of Winnings in respect of each Prize Category when the Jackpot for that Prize Category or for the whole Bookmaker Game has been changed.

The Operator shall inform the Players on the amount of any such changed Jackpot in an appropriate manner, in particular by publishing the amount of the applicable Jackpot on the Website.

A Player, who has ordered a Bet, has the right to request the Operator for cancellation of only those Bet/-s which were ordered for the draw for which the Jackpot has been lowered by more than 30% of the Underlying Lottery Jackpot’s value for the respective draw and the new Jackpot is lower than 50 million EUR.

The Player, who decides to cancel his Bet/-s, must do so at least 3 hours before the Bet Deadline for the respective draw only by means of contacting the Operator’s Customer Support Center by telephone at the telephone number displayed on the Website. The Operator does not accept any Bet cancellations thereafter or by other means than by telephone contact of the Operator’s Customer Support. It is the responsibility of the Player to call the Support Center as soon as possible. The Bet cancellation has been done successfully, only if the Player receives a confirmation of the Bet cancelation, in which case the paid Stake will be reimbursed to the Player to his Player Account.

7.8 The Operator reserves the right to remove any Bookmaker Game on the Website in case of its malfunction or misconfiguration that causes incorrect behaviour and to adjust the funds credited to the Player Account erroneously.

Winnings

8.1 Winnings shall be credited to a Player Account and the Player is able to view any such Winnings on their Player Account on the Website. The Winnings will be credited once these are received by the Operator from the Bookmaker. In addition, the Operator may decide, but is not obliged, to inform the Player with respect to Winnings by email, SMS/text message or other ways especially if there is a large win. Information about Winnings can be provided in euro or in any other currency.

8.2 The Player can choose to either use their Winnings to pay for more Bets or ask the Operator to pay the Winnings into the Bank Account in accordance with clause 6.9 above, exceptions may apply pursuant to the Promotional Terms and Conditions or special Bonus Rules.

The Operator may only transfer amounts in the Reference Currency to the Player’s payment method (Bank Account, credit card, or other) and only after the Player has submitted sufficient evidence to the Operator that such a bank account is held in their name, in particular a copy of the front and back of a valid identification document, whose information fits the name and date of birth of the Player provided with the Player Account. The Operator may also request a copy of a Bank Statement to confirm that the Bank Account is held in the name of the Player.

8.3 The Operator will only pay out those Winnings which the Operator has received from the Bookmaker after, where applicable, the hedging and risk cover partners have settled the claim for the relevant Winning.

8.4 The Operator may require that the relevant Player provides documents of identification so that the Operator can assure itself as to the validity of the Player Account details and the Player’s entitlement to the Winnings in accordance with these Terms and Conditions. The Operator may withhold payment of Winnings until the verification of the Player is concluded to its satisfaction. All requested and required documents must be provided by the Player no later than 3 weeks after the date of the Bookmaker Game’s draw or the Winnings shall be forfeit.

8.5 The Operator may decide to pay out Winnings up to 50 million units of the Reference Currency as one lump sum, any Winnings over this amount may be paid to the winner/s in equal yearly instalments over a period of thirty (30 years).

8.6 Winnings are calculated and credited in the Reference Currency in which the Bet was placed. The exchange rate used is the Euro Foreign Exchange Reference Rate published by the European Central Bank (ECB rate) for the respective draw date. This also applies for annuity payments. Winnings are converted only once into the Reference Currency on the day of the draw. All subsequent payments are also subject to the same exchange rate.

8.7 Winnings are tax-free or non-taxable in many countries. Any applicable Bank charges, taxes, duties or levies on Bets and/or Winnings shall be charged to the Player. The Player is primarily responsible for correct payment of Bank charges, taxes, duties and levies in their jurisdiction. In the event that the Operator is required to pay any Bank charges or taxes directly to the regulatory authorities of a country in respect of a Winning, then the Operator shall be entitled to subtract those payments from the Winning or claim them from the relevant Player.

If the Operator credits the Player Account by error with Winnings or other funds, that do not belong to the Player, whether due to a technical or human error or otherwise, the Player shall notify the Operator immediately by email. Any such outstanding amount remains the Operator’s property and will be deducted from the Player Account. If prior to the Operator becoming aware of the error the Player has withdrawn such outstanding funds, without prejudice to other remedies and actions that may be available at law, the Player shall return such outstanding funds and the Operator may claim such funds from the Player and/or deduct the Player Account at any time when there are any funds available on the Player Account.

Placing of Bets

11.1.1 The Player effects an instruction to the Operator to place Bets with the Bookmaker on their behalf by filling out and submitting a Virtual Betting Ticket on the Website for their chosen Bookmaker Game/s and paying the Stake/s thereafter.

If not specified by the Promotional Terms and Conditions or special Bonus Rules otherwise, the Player may either use funds available in his Player Account to settle the outstanding Stake or pay the Stake by using the chosen payment method during check out.

11.1.2 After the Player has filled out the Virtual Betting Ticket/s, the Bet/s transfers to the Shopping Cart Sections of his Player Account. When the Player has finished ordering Bets, he may then proceed to the Shopping Cart to effect payment.

11.1.3 The Player pays the Stakes by providing their payment details and by clicking on the applicable button in the Shopping Cart. The Player may be required to acknowledge further payment terms. 11.1.10 If an Underlying Lottery makes multiple draws on the same date, then unless otherwise specified by the Bookmaker, a Bet will apply only to the main draw taking place on that date (or, where no main draw takes place, the first draw), under exclusion of any other draw made by the Underlying Lottery.

11.1.11 If an Underlying Lottery’s draw does not take place or no draw result is published or officially announced, all Bets on that draw will stand for the rescheduled draw (or, if there is none, the next available relevant draw).

11.1.12 After a successful purchase the Player can view the Bet’s status in the Player Account. The Player Account shows an active status of the Bet (“Playing” or any similar status) and the Player receives an order confirmation notice as soon as the Operator has received the Bet for onward placing with the Bookmaker. An inactive status of the Bet (“Pending” or any similar status) will be shown in the Player Account if the Bet has not been received by the Operator or accepted by the Bookmaker. General Betting Rules

11.2.1 The Bookmaker will accept Bet/s placed by the Operator on behalf of the Player, where instructions to place the Bet/s have been submitted on the Website by the Player and the Bet/s has been subsequently placed with it by the Operator.

  • “Lotería de Navidad”, operated by the Spanish Loterías y Apuestas del Estado.

11.2.2 Player acknowledge that the jackpot values displayed on the Website are approximate estimates of what the jackpot will be using certain assumptions, such as the current or future jackpot being won or rolled over. The displayed value is an estimate and is not legally binding. The Operator is not liable for any inaccuracies between the estimated jackpot and the actual jackpot.

11.2.3 The Bookmaker calculates the Winnings for each Bet. The calculation is different per Bookmaker Game and Prize Category.

11.2.4 By choosing the option “Jackpot Chaser” the Player may automatically choose to extend the Virtual Betting Ticket until the current Jackpot of the relevant Bookmaker Game’s highest Prize Category has been won. The period for withdrawal encloses only the next draw date.

11.2.5 The “When Jackpot” feature allows the Player to define the amount of Jackpot to be reached in the relevant Bookmaker Game in order to start his Bet participating in the Bookmaker Game.

11.2.6 The Player may select the “Boosterball” option. By selecting it, the Player is allowed to achieve Winnings that are much better when 3 numbers are matched than those achieved in the Bookmaker Game.

Winnings with the Boosterball option may reach up to a 1000-multiple of the amount of Stake selected using the Boost ‘ o’ Meter Slider on the Website.

By selecting the Boosterball option, after having selected the numbers on a Virtual Betting Ticket, if three numbers selected in one Bet are matched to the winning numbers drawn in the respective Underlying Lottery, the Player will win the amount displayed when choosing the Stake amount using the Boost’o’meter, additionally to the Winning for an eventually reached Prize Category.

11.2.7 On one Virtual Betting Ticket, either the option DoubleJackpot or NumberShield can be played.

11.2.8 Winnings for Bets in the Prize Category 1 with NumberShield are calculated under the assumption that there had been no other Covered Bets and no Underlying Lottery Winning Tickets in that Prize Category for the particular draw. Winnings for Bets with NumberShield are therefore not shared.

11.2.9 If a Bet in the Prize Category 1 is with DoubleJackpot, the Winnings are doubled.

11.2.10 Every field displayed on the Virtual Betting Ticket, allowing the selection of the relevant number combination as described further below for each Bookmaker Game, represents one Bet. At least one Bet has to be selected on every Virtual Betting Ticket. The Stakes are displayed on each Virtual Betting Ticket.

11.2.11 Only the highest of the available Prize Categories achieved by and relevant to that Bet can be won on each Bet.

11.2.14 Winnings in MegaMillions and PowerBall

If the Operator chooses the Annuity Option, the first payment will be made as soon as possible after the draw, with the next 29 payments at one-year intervals. The level of payments is calculated such that the payments rise by 4% from year to year until the full amount of the Winning has been paid out. The option to pay out Winnings in one lump sum (“Cash Option”) is not available at the Operator at the time being.

Withholdings for Winnings in MegaMillions and PowerBall — The Operator retains withholdings of Winnings in the highest two Prize Categories in the amount of 35%, in order to put the Player in a similar economic position as if they had played the Underlying Lottery.

11.4.2 Powerball and MegaMillions

Example 1
There is only one Covered Bet in Prize Category 1 and no Underlying Lottery Winning Ticket has been announced in Prize Category 1 in respect of an Underlying Lottery Jackpot of $ 300.000.000,00. The Winnings payable after withholdings in respect of that single Covered Bet in Prize Category 1 is $ 195.000.000,00.

Example 2
There is only one Covered Bet in Prize Category 1 and two Underlying Lottery Winning Tickets Bets have been announced in Prize Category 1 in respect of an Underlying Lottery Jackpot of $ 300.000.000,00. The Winnings payable after withholdings in respect of that single Covered Bet in Prize Category 1 would be $ 65.000.000,00.

Example 3
There are two Covered Bets in Prize Category 1 and one Underlying Lottery Winning Ticket has been announced in Prize Category 1 in respect of a Underlying Lottery Jackpot of $ 300.000.000,00. The Winnings payable after withholdings in respect of each Covered Bet in Prize Category 1 would be $ 65.000.000,00.

11.4.3DinoLotto

Example 1
If there is one Covered Bet and one Underlying Lottery Winning Ticket in Prize Category 1 for the relevant draw, then the Winnings payable in respect of the Covered Bet in Prize Category 1 of the DinoLotto game would be € 25.000.000,00.

Syndicate Games

11.5.1 A lottery syndicate is a group of individuals who choose to play the same number combinations together as a group. All Winnings from Bets played by one syndicate will be shared between all participating members of that syndicate, depending on the amount of shares each individual has.

11.5.2 Euro Combi play will allow you to be entered into a Tuesday and Friday EuroMillions draw, with 55 Bets in each; and a Friday-night EuroJackpot draw with 45 Bets. Any Winnings from the 155 Bets played in total will be divided between the shares in the syndicate.

11.5.3 A share refers to the percentage of Winnings a Player is entitled to in a syndicate. The Euro Combi has a maximum of 88 shares.

11.5.4 US Combi play will allow you to be entered into the Wednesday and Saturday MegaMillions draws, with 15 Bets in each; and a Thursday and Sunday Powerball draw with 26 Bets in each. Any Winnings from the 82 lines played in total will be divided by the number of shares in that syndicate.

11.5.5 A share refers to the percentage of Winnings a Player is entitled to in a syndicate. The US Combi has a maximum of 93 shares.

11.5.6 Players participating in a syndicate will receive an email directly after each draw informing them of all their Winnings. A Player can also login to the Player Account at any time and check their latest Winnings.

Rights of the Bookmaker

11.6.1 The Bookmaker pays out Winnings to the Operator only. The Bookmaker may at its discretion decide about the validity of a Bet or a Player’s entitlement to Winnings and void a Bet, if instructed to do so by the Operator or if the Player is found to be in breach of these Terms and Conditions.

11.6.2 When deciding about the Player’s entitlement to Winnings, the Bookmaker may base its decision on information that is researched and/or held by Operator and forwarded to the Bookmaker or the Bookmaker may perform its own research using information provided by a third party.

11.6.3 In special circumstances the Bookmaker may offer to place any such Bet on the next relevant draw or to credit the Player’s Player Account with the relevant sum. If any Bet is otherwise voided by the Operator in accordance with these terms, the relevant sum associated with that Bet may be forfeited to the Bookmaker, except where the Bet was placed by a Player who is under the age of 18. In this case, the relevant sum will be repaid to the Operator on behalf of the Player.

11.6.4 The Bookmaker reserves the right:

  1. to set off the amounts of any unpaid Bets for Bets owed by that Player against a Player’s Winnings;
  2. to terminate, vary or suspend any product offered on the Website, immediately and without prior notice, for any reason and at the Bookmaker’s sole discretion; and
  3. to require that, but shall not be obliged, the relevant Player provide identification documents in order to enable the Bookmaker to satisfy itself as to the validity of Player Account details and the Player’s entitlement to the Winnings in accordance with these Terms and Conditions. The Bookmaker may withhold payment of Winnings until any such matter has been fully resolved; and
  4. to pay Winnings partly or fully in installments at EU Lotto’s sole discretion; and
  5. limit, cancel and refuse Bets in case the Operator reasonably assumes that the betting pattern of the Player takes place in such a way that the system is being abused.

11.6.5 The Bookmaker decides about acceptance of a Bet and may eventually cancel a Bet prior to the beginning of the relevant draw. If the Bookmaker does not accept a Bet or does cancel a Bet, the Player will be reimbursed accordingly.

Complaints

11.7.1 For filing complaints the Player may contact the Customer Support Service via email (%EMAIL%). Each correspondence shall be marked as “Complaint” and shall receive a reference number, provided that the Operator has allocated a reference number to the relevant complaint.

11.7.2 The complaint will be attended to by an employee from the Customer Support Service. We endeavor to resolve complaints within 48 hours after their receipt. In case the Player considers for a good reason that the complaint was not resolved correctly, the complaint will be attended to by the head of Customer Support Service or by a director of the Operator.

Should Players from UK, despite of our endeavor, be dissatisfied, they can raise their concerns with the independent ADR service who will consider any case regarding betting or gaming transactions pursuant to its rules.

Commitment to Decisions

13.1 In the event of a dispute in respect of a Bet or the payment or awarding of any Winnings, the payment of the Winnings may be withheld until any dispute has been fully concluded.

13.2 Where a final decision is made or any discretion referred to above is exercised by the Bookmaker or by the Operator, the Player may be reimbursed with the sum of the relevant Stake or may be offered a new Bet.

General Liability and Force Majeure

14.1 The Operator and the Bookmaker will not be liable to a Player or third parties, whether in contract, tort (including negligence, breach of statutory duty or other tort) or otherwise

  1. for any loss of business, revenue, anticipated savings or profits (whether direct or indirect); or
  2. for any indirect, special or consequential loss, damage, costs or other claims, howsoever caused or arising, whether through non-supply or late supply of the Website or any other service available through the Website, non-performance of these Terms and Conditions or otherwise.

14.2 These Terms and Conditions do not affect the Operator’s or the Bookmaker’s liability for cases of death and injuries to persons because of negligence of the Operator or the Bookmaker or for fraud.

14.3 Without prejudice to any other provision of these Terms and Conditions, the Operator and Bookmaker shall not be liable to any person:

  1. for any event beyond its reasonable control including without limitation, an act of God, actual or threatened war or other threat or challenge to governmental authority, confiscation, nationalisation, requisition or destruction of or damage to property by or under the order of any Government or public or local authority, strike, lockout, industrial action, fire, flood, drought, tempest, power cut and/or failure, delay or obstruction of, or caused by any network, broadcasting or telecommunications service;
  2. for the failure of, or damage or destruction to, or any errors caused by the computer systems or records or any third party (including, without limitation, the Website), or any aspect of the foregoing;
  3. for delays, losses, errors or omissions in or made by the postal or other delivery service or by the banking system;
  4. for any other action or event that prevents or hinders the acceptance of a Bet;
  5. for the refusal to sell a Bet to any person or to allow any person to place a Bet; or
  6. for any losses caused to Players including misuse or unauthorised use of passwords, money lost by gambling and failure or malfunction of the equipment or technology of the relevant Player or their service provider.

14.4 The Player uses the Website and participates in any product provided on the Website at their own risk. The Website and the products are provided without any warranty whatsoever, whether express or implied.

14.5 Neither the Operator nor the Bookmaker shall be responsible for any downtime, server disruptions, lagging, or any technical or political disturbance to the use of the Website, the products or any result of play. In the event of a malfunction, the affected product participations may be decided to be void. Refunds may be given accordingly.

14.6 The Player understands and acknowledges that if there is, or if the Player is later notified that there is or has been a malfunction or interoperability, any Stake affected by such malfunction or interoperability shall be deemed invalid and the result, null and void, regardless of whether Winnings have been paid out. Winnings obtained by a Player due to a malfunction shall remain the property of the Operator and/or the Bookmaker, as applicable. Any Stake from said Winnings played in any subsequent game round or rounds and the resulting shall also be deemed invalid and any result, null and void. The Player is required to return any Winnings obtained under this clause immediately to the Operator.

14.7 To the fullest extent permitted by law, the Operator and the Bookmaker respectively disclaim all liability for any cost, expense loss, damage, claim and/or liability to the Player or any third party, deemed or alleged to have arisen out of or in connection with the use of the Website or its content, or the Player’s use of the Website or participation in any product on the Website; including without limitation, delays or interruptions in operation or transmission, loss or corruption of data, communication or lines failure, any misuse of the Website or its content or any errors or omissions in content.

To the extent possible at law, the Operator and the Bookmaker exclude any warranty, express or implied, that the software, the products on the Website and the Website are fit for their purpose, free from errors and accessible without interruptions.

Liability of Operator

15.1 The Operator endeavours to ensure that the Website and the services available through it are available to Players as much as is reasonably possible, but the Operator cannot and does not guarantee that:

  1. the Website and its content will be available at any specific time or for any specific period;
  2. the Website’s features, functionality or performance will meet the Player’s requirements or those of third parties; or
  3. the Website or its features and functionality are, or will be, compatible with, or available on, the device or system used by a Player to access the Website. Furthermore, the Operator does not warrant that any alerts or advices a Player may choose to subscribe to will be provided in advance of the deadline for instructing the Operator to place a Bet on the relevant draw and shall have no liability to a Player if any such alerts or advices are incorrect or delayed or are not sent to or not received by the Player.

15.2 The Operator will use reasonable endeavours to ensure that the results and Winnings provided by it are correct. In spite of all endeavours for warranty of the accuracy of this information the Operator shall have no liability for errors in respect of the information displayed on the Website, errors discovered only after Winnings have been paid out, error is based on incorrect information published by the Underlying Lottery or relating websites relevant to those Winnings.

15.3 The Operator will not accept responsibility for loss or damage because of the insolvency of third parties, including banks maintaining the bank accounts of the Operator.

15.4 The liability of the Operator against the Player is limited to the aggregate sum, which the Player has spent for a coming draw or Bet.

15.5 The decision whether the risk cover is provided by means of hedging of Bets or by purchasing real lottery tickets lies solely with the Operator.

The Operator has the right to cover its risk in its own name or its representatives’ names, irrespective of whether the Winnings on offer are risk covered by another means or not. The Bookmaker has taken out Risk Cover Contracts with reputable Risk Cover Partners, covering the top prizes by hedging and purchasing lottery tickets, to ensure that prizes won can be paid out to the Players. The Operator and the Bookmaker endeavour to comply at all times with the conditions of these Contracts. Nor the Operator nor the Bookmaker can be held responsible or liable should the Risk Cover Partners fail to pay out Winnings to the Operator.

15.6 Products available on the Website are consumed instantly during gameplay. Thus, the Operator cannot provide refunds, returns of goods, or cancellation of delivered service after the play. The Players participate in a game with real money, thus real money value will be deducted from the Player Account instantly when participating in a game.

16.1 The Bookmaker shall not be liable for any loss or damage that may arise from the insolvency of third parties, including the Operator or any bank, including (without limitation) any bank with which the Bookmaker maintains its accounts.
